The recent decision of the UK Supreme Court in Halliburton v Chubb (27 November 2020) has raised a number of difficult issues with regard to confidentiality in international arbitrations and the obligations of arbitrators to give proper disclosure in relation to potential conflicts of interest. The decision has huge practical implications for arbitrators in the day-to-day conduct of their arbitral practices which they will have to bear in mind when accepting appointments and conducting arbitrations.
