About the Course
The CISG represents the culmination of over 60 years of negotiations to harmonize the law governing the international sale of goods. It has gained worldwide acceptance since its entry into force in 1988, with over 80% of the world’s trade in goods potentially governed by the CISG. As of December 2022, it entered into force in Hong Kong. Yet very few practitioners in Hong Kong are familiar with it or even aware of it. This situation presents a potential disadvantage to Hong Kong merchants, and a real threat to their lawyers and arbitrators, who ignore it at their peril. Lawyers may give up advantages or on the contrary, encounter pitfalls to the detriment of their clients. What does an arbitrator do when faced with a case clearly governed by the CISG, but the parties have ‘forgotten’ to plead it?
The Hong Kong Institute of Arbitrators has teamed up with the Vis East Moot Foundation, which educates and promotes the CISG and good arbitration practice to law students and lawyers, to present this introduction to a law unlike any other in Hong Kong.
