The webinar will consider the approach to identifying the applicable law of arbitration agreements in the light of two recent UK Supreme Court judgments – Enka Insaat Ve Sanayi AS -v- OOO Insurance Company Chubb [2020] UKSC 38 and Kabab-Ji SAL (Lebanon) -v- Kout Food Group (Kuwait) [2021] UKSC 48. In Enka the question of which law governed the validity and scope of an arbitration agreement arose before any arbitration had taken place. In Kabab-Ji the governing law was in the context where an arbitration had already taken place and proceedings had been brought to enforce an award made by the arbitral tribunal.
