One of key dispute areas with voluminous cases which could happen due to two main reasons (1) lack of clarity in the charterparties (2) lack of care & communication during the operations.
We will look at the two key statements that must be true before tendering a Valid NOR which should also be contractual before the laytime can start. This will open the way for discussing a few key cases for “Arrived Ship” with focus on Johanna Oldendorff, Arundel Castle, Maratha Envoy etc. while “Ready in all respects” will bring in MEXICO I and possibly Delian 1971.
Time permitting, we may also look at the London arbitration 13/19 briefly to say a few words about “how an invalid NOR sometimes may not prevent the laytime from counting”.
