About the Webinar

The Webinar will introduce the standard of fair and equal treatment in international investment agreements and its application in investor-state arbitration. The webinar will also identify the interplay of fair and equal treatment with other protections under international investment agreements and under the International Covenant on Civil and Political Rights, in investor-state disputes.

The webinar will cover the followings:

  • Source and development of FET as an international minimum standard
  • Standard and scope of FET in international investment agreements
  • Application of FET in investor-state disputes
  • Role of the investor’s legitimate expectations and interplay of FET with other protections under IIAs
  • Reference to the ICCPR in investor-state disputes

About the Speaker

Dr. Jane Willems
Arbitrator, Mediator, BW ARBINTL LTD

Dr. Jane Willems specializes in international investment law and international arbitration. She is an Associate Professor of Law and the Associate Director of the LLM in International Arbitration & Dispute Settlement, at Tsinghua University School of Law, Beijing.

Dr. Willems has served as arbitrator or chair in numerous international commercial arbitrations involving ICC, CIETAC, BAC, HKIAC and UNCITRAL Rules and in investor-state arbitration (PCA-UNCITRAL). She has also served as counsel for the Lao PDR in BIT based investment arbitration proceedings.

Dr. Willems is a member of the Advisory Board of the Asian Academy of International Law (AAIL). She is the delegate of AAIL at the UNCITRAL Working Group III (Investor-State Dispute Settlement Reform).

She is admitted to practice to the Bar of the State of California and to the Bar of Paris. She holds a Ph.D. in Law.
