The webinar will consider the approach to identifying the applicable law of arbitration agreements in the light of two recent UK Supreme Court judgments – Enka Insaat Ve Sanayi AS -v- OOO Insurance Company Chubb  UKSC 38 and Kabab-Ji SAL (Lebanon) -v- Kout Food Group (Kuwait)  UKSC 48. In Enka the question of which law governed the validity and scope of an arbitration agreement arose before any arbitration had taken place. In Kabab-Ji the governing law was in the context where an arbitration had already taken place and proceedings had been brought to enforce an award made by the arbitral tribunal.
